Terms and Conditions of Service

These Terms and Conditions ("Terms") apply to all services provided by Visions West Productions ("we", "us", "our") to the Client ("you", "your"). By engaging our services, you agree to the following terms:

1. Scope of Services

We will provide services as agreed upon in writing, verbally, or via email. Any changes to the scope must be agreed to in writing by both parties.

2. Payment Terms

Invoices will be issued upon completion or as otherwise agreed. Payment is due within 14 calendar days of the invoice date, unless otherwise specified in writing.

3. Overdue Accounts

If payment is not received by the due date:

• We reserve the right to charge late fees and/or interest on overdue amounts at a rate of 2% per month or the maximum allowed by law, calculated daily.
• We may suspend or withhold services until the account is brought up to date.
• We reserve the right, at our sole discretion, to refer unpaid accounts to a debt collection agency or pursue legal recovery. You agree to bear any costs incurred as a result of debt recovery action, including collection agency fees and legal expenses.

4. Cancellation and Rescheduling

Any cancellation or rescheduling of services must be provided in writing with reasonable notice. Fees may apply for cancellations with insufficient notice.

5. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages resulting from the use of our services. Our total liability for any claim arising out of or relating to our services is limited to the amount paid for those services.

6. Confidentiality

We will treat any confidential information you provide as confidential and will not disclose it to third parties without your prior written consent, except where required by law.

7. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts in that location.
